BHealthE is not affiliated with or endorsed by any federal or state government agency or program, including Medicare, Medicaid or any state health insurance marketplace.

Your use of third-party sites is at your own risk and subject to their terms.
10.1. Our collection, use and disclosure of information through the Site are described in our Privacy Policy, which is incorporated into these Terms.
11.1. THE SITE AND ALL CONTENT ON IT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. BHEALTHE DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT CONTENT IS ACCURATE, COMPLETE OR CURRENT. 14.1. Governing Law; Forum. These Terms and any dispute arising out of or relating to the Site are governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules. Subject to Section 14.2, you agree to the exclusive jurisdiction of the state and federal courts located in Winnebago County, Illinois.
14.2. Arbitration. [OPTIONAL: Any dispute arising out of or relating to the Site or these Terms that cannot be resolved informally will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules before a single arbitrator. The Federal Arbitration Act governs this Section. Either party may bring an individual claim in small claims court instead. BHealthE will pay all arbitration filing and administrative fees in excess of the amount you would pay to file in small claims court. This Section does not apply to any dispute between BHealthE and an Advisor, which is governed by the Independent Advisor Agreement.]
14.3. Class Action Waiver. [OPTIONAL: YOU AND BHEALTHE AGREE THAT ANY DISPUTE WILL BE RESOLVED ON AN INDIVIDUAL BASIS AND NOT AS A CLASS, CONSOLIDATED OR REPRESENTATIVE ACTION.]

Revisions apply to your use of the Site after the effective date, and we will provide notice on the Site of any material change. Your continued use of the Site after the effective date constitutes acceptance. Revisions to these Terms do not amend the Independent Advisor Agreement.
16.1. These Terms and the Privacy Policy are the entire agreement between you and BHealthE regarding the Site. If any provision is held unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms; we may assign them to an affiliate or successor. You consent to receive communications from us electronically. Questions about these Terms may be directed to support@bhealthe.com or to the address in Section 1.3.
